Welcome to Telky Pet! These Terms of Service ("Terms") describe your rights and responsibilities when you use our website, store, and related content, features, tools, products, and services (the "Services"). The Services are operated by:

The terms "we", "us" and "our" refer to TelkyPet OÜ. Our store is powered by Shopify, which enables us to provide the Services to you.
Please read these Terms carefully. By using the Services, you agree to these Terms and acknowledge our [Privacy Policy] and [Return & Refund Policy]. If you do not agree, please do not use the Services.
Nothing in these Terms limits, excludes, or replaces your mandatory rights as a consumer under EU law or the law of your country of residence - including the 14-day right of withdrawal and the legal guarantee of conformity. Where any provision of these Terms conflicts with such rights, your statutory rights prevail.
1. Access and Account
By using the Services, you confirm that you are at least 18 years old or the age of majority in your country of residence.
When purchasing or creating an account, you may be asked to provide information such as your email, billing, payment, and shipping details. You confirm that all information you provide is accurate, current, and complete, and you agree to keep it updated.
You are responsible for keeping your account credentials secure and for activity under your account. Accounts may not be transferred, sold, or assigned to another person.
2. Our Products
We make every effort to represent our products accurately in our store. However, colors and product appearance may differ slightly from how they appear on your screen due to your device and display settings.
Product descriptions may be updated from time to time. We may discontinue products or limit quantities offered per person or region. None of this affects orders already accepted or your statutory rights in respect of products you have purchased.
3. Orders
When you place an order, you make an offer to purchase. Your order is accepted when we send you an order confirmation, after receiving and processing your payment. We may decline an order for legitimate reasons — for example, suspected fraud, unavailability of stock, or an obvious pricing error — and will notify you using the contact details you provided, refunding any amounts already paid.
If you wish to cancel an order before it has shipped, contact us at info@telkypet.com as soon as possible and we will do our best to accommodate it. In any case, if you are an EU consumer, you retain your 14-day right of withdrawal after delivery, as described in our [Return & Refund Policy].
Purchases through our store are intended for personal or household use, not for commercial resale.
4. Prices and Billing
Prices displayed in our store include VAT where applicable. Shipping costs, if any, are shown separately before you complete your order. The price charged is the price in effect at the time you place the order, as confirmed in your order confirmation email.
Prices, discounts, and promotions may change over time; changes do not affect orders already placed. Promotions may be subject to their own specific conditions, which will be communicated with the promotion.
You agree to provide accurate and complete payment information and confirm that you are authorized to use the payment method provided.
5. Shipping and Delivery
Delivery times shown in our store are estimates. Unless otherwise agreed, we will deliver your order within 30 days of order confirmation. If we cannot deliver within this period, we will inform you, and you may agree on a new delivery date or cancel the order for a full refund.
We are not responsible for delays caused by circumstances outside our reasonable control (such as carrier disruptions or customs processing), but we will keep you informed and assist in resolving any issues.
Risk of loss or damage to the products passes to you only when you (or a person designated by you, other than the carrier) take physical possession of the goods. If your parcel arrives damaged or does not arrive, contact us at info@telkypet.com and we will resolve it.
6. Legal Guarantee and Returns
All products are covered by the legal guarantee of conformity of at least 2 years under EU law, as described in our [Return & Refund Policy]. If a product is defective or not as described, you are entitled to repair, replacement, or — where applicable — a price reduction or refund, free of charge.
EU consumers also have a 14-day right of withdrawal, and we additionally offer a voluntary 30-day return policy. Full details, conditions, and the model withdrawal form are set out in our [Return & Refund Policy].
7. Product Reviews
Our store may display customer reviews. 8. Intellectual Property

You may use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, or transmit any material from the Services without our prior written consent. The Telky Pet name, logo, and product names are trademarks of TelkyPet OÜ. Shopify's name and logo are trademarks of Shopify. All other trademarks belong to their respective owners. All rights not expressly granted are reserved.
9. Optional Tools and Third-Party Links
The Services may give you access to third-party tools or contain links to third-party websites that we do not control. Such tools and websites are provided "as is", and your use of them is at your own discretion and subject to the relevant third party's own terms and policies. We are not responsible for the content, accuracy, or practices of third-party websites. Questions or claims regarding third-party products or services should be directed to the relevant third party. This section does not limit any liability that cannot be excluded under applicable law.
10. Relationship with Shopify
Telky Pet is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Telky Pet. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Telky Pet, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Telky Pet.
11. Privacy
All personal data collected through the Services is processed in accordance with our [Privacy Policy]. Because the Services are hosted by Shopify, certain personal data is also processed by Shopify as described in the Shopify Consumer Privacy Policy.
12. Feedback and Reviews You Submit
If you submit ideas, suggestions, reviews, or other content ("Feedback"), you grant us a worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and display that Feedback to operate, improve, and promote the Services.
You confirm that you own or have the necessary rights to your Feedback, that it is accurate, that you have disclosed any compensation or incentive received in connection with it, and that it does not infringe the rights of any third party or contain unlawful, abusive, or obscene content or malware. You may not submit Feedback under a false identity. We may remove Feedback that violates these Terms or applicable law. We are under no obligation to keep Feedback confidential or to compensate you for it.
13. Prohibited Uses
You may use the Services for lawful purposes only. You may not use the Services to: (a) violate any applicable law; (b) infringe intellectual property or other rights of Telky Pet or third parties; (c) harass, abuse, defame, or harm any person; (d) transmit false or misleading information; (e) send spam or unsolicited promotional material; (f) impersonate any person or entity; (g) upload viruses or malicious code; (h) scrape, crawl, or collect personal data of others; or (i) interfere with or circumvent the security or operation of the Services.
We may suspend or terminate your access to the Services if you materially violate these Terms. Suspension or termination of website access does not affect your rights in respect of orders already placed or products already purchased.
14. Errors, Inaccuracies and Omissions
Occasionally, information in the Services may contain typographical errors or inaccuracies relating to descriptions, pricing, promotions, or availability. We may correct such errors and update information at any time. Where a pricing error is obvious and could reasonably have been recognized as such, we may cancel the affected order and refund any payment made.

The general information presented on the Services is provided for information purposes and may not always be complete or current. The website itself is provided "as is" and "as available", and we do not guarantee that its operation will be uninterrupted or error-free.
This section applies to the website only. It does not limit or exclude the legal guarantee of conformity for products or any other statutory consumer right.
16. Liability
Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) damage caused by intent or gross negligence; (c) damage caused by defective products under applicable product liability law; (d) breach of your statutory consumer rights; or (e) any other liability that cannot be excluded or limited under applicable law.
Subject to the above, we are not liable for indirect or consequential losses (such as loss of profits or loss of data) that were not reasonably foreseeable, or for damage caused by circumstances outside our reasonable control.
17. Your Responsibility
If your unlawful use of the Services, your breach of Section 12 (Feedback) or Section 13 (Prohibited Uses), or your violation of third-party rights causes a claim against Telky Pet or Shopify by a third party, you agree to compensate us for the resulting damages and reasonable costs, to the extent you are responsible for them under applicable law.
18. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed, and the remaining provisions will remain in full force and effect.
19. Waiver; Entire Agreement
Our failure to enforce any provision of these Terms does not waive our right to do so later. These Terms, together with the policies referenced in them, constitute the entire agreement between you and us regarding your use of the Services and supersede prior versions.
20. Assignment
You may not transfer or assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of our business, provided your rights are not diminished.
21. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Estonia. However, if you are a consumer residing in the European Union, you also benefit from the mandatory consumer protection provisions of the law of your country of residence, and nothing in this clause deprives you of that protection.
Disputes may be brought before the courts of Estonia. If you are an EU consumer, you may also bring proceedings in the courts of your country of residence, and any proceedings against you may be brought only in the courts of your country of residence.

You may also contact the consumer dispute resolution body in your country of residence; in Estonia, this is the Consumer Disputes Committee at the Consumer Protection and Technical Regulatory Authority (TTJA).

We may update these Terms from time to time. The current version is always available on this page, with the "Last updated" date shown above. Changes apply prospectively only and never affect orders you have already placed. We will notify you of material changes as required by law before they take effect.
